The Employment Permits Regulations 2014: S.I. No.432 of 2014
Wednesday, 03 December 2014Earlier this year, we circulated an ebulletin about the Employment Permits (Amendment) Act 2014 which was enacted on 31 July 2014. Since then, the Minister for Jobs, Enterprise and Innovation published the Employment Permits Regulations 2014 on the 1st October 2014 and these Regulations have been recently amended with effect from the 11 November 2014 by the introduction of the Employment Permits (Amendment) Regulations 2014. These new Regulations amend Schedule 3 which sets out the type of employments for which an employment permit may be granted and Schedule 4 which sets out the categories of employment for which an employment permit will not be granted.
The Regulations set out the different classes of employment permit that may be granted by the Minister and the categories of employment in which an employment permit may and may not be granted. The Regulations contain provisions regarding applying for and renewing permits, set out the applicable fees and prescribe the forms to be used by applicants and the form in which the permits are issued. In addition the Regulations list the regulatory bodies or Government Minister from which or whom registration or recognition of qualifications is required.
Schedule 3 of the Regulations sets out the type of employments for which an employment permit may be granted. These are employments where there is a shortage in terms of qualifications, experience or skills which are required for the proper functioning of the economy. Schedule 4 of the Regulations sets out the categories of employment for which an employment permit will not be granted.
