Employment Law in the Public Sector Annual Conference 10 May 2023
Friday, 21 April 2023The ByrneWallace LLP Employment Law team are hosting our annual conference dealing with employment law developments in the public sector, in association with Legal Island, at our offices from 9.15am to 1.00pm on Wednesday, 10 May 2023.
This event is specifically designed with public sector organisations in mind, and the topics for discussion on the day have been chosen based on feedback from HR professionals working in this sector.
The full programme of topics is as follows:
- Work Life Balance and Miscellaneous Provisions Act 2023:
This new Act will be a key development for all employers in the public sector to be aware of. This session explores how the Bill will impact:
- Flexible working for parents and carers
- Remote working
- Domestic violence leave
- Leave for medical care purposes
- Other aspects of the Bill
- Update on recent equality and disability law developments:
Employment equality is a key area in the public sector and this session will focus on the most important developments in this area, to include:
- Definition of a disability.
- Procedural requirements and dismissal cases.
- Developments in reasonable accommodation including IHEC Code of Practice.
- Recent developments in age discrimination and retirement.
- The European Union (Transparent and Predictable Working Conditions) Regulations 2022:
- Changes to Probationary Periods
- New information required when varying written Employment Terms.
- New rules around exclusivity / parallel employment.
- Changes to training requirements for employees.
- Minimum predictability of work and amendments to the Organisation of Working Time Act 1997.
- Employment outside of Ireland and the information that must be provided to employees.
- Other developments in the Regulations and how they will affect the public sector.
- 2023 Employment Case Law Round-Up for the Public Sector:
There have been a number of important cases since our last event in 2022. Here are just a few of the top cases we will cover at this year’s event:
- Maurice Power v Health Service Executive [2022] IESC 17 – Supreme Court Fixed term contracts case.
- Nolan v Fingal County Council [2022] IEHC 335 – Protected disclosures & penalisation.
- Leonard v Health Service Executive [2022] IEHC 487 – Injunction preventing appointment of another person to a role.
- The Board of Management of Wilson's Hospital v Enoch Burke [2022] IEHC 719 – Disciplinary process & injunction.
